LM in the communityAbout a year and a half ago, I was introduced to a Christian non-profit organization called House of Hope based in Clayton, NC.  House of Hope is a therapeutic school, home, and counseling center for troubled teenage girls, ages 12-17.  The girls in this program become students and residents of the house for the time they are working through each “phase” of the program.  It is here that they are able to get the necessary one on one assistance with their education and home life.

On Thursday nights, the house is open to outside groups for a social night.  A few of my friends and I decided to make our own “group” and sign up.  We prepared dinner and took it over to the house where we met the residents, 8 girls and the house mom.  After introductions, we all sat down for dinner and ended up talking and laughing for two hours before we realized it was time to go. That night marked the beginning of a tradition and we have been visiting every 4-6 weeks since.

Not to brag… but the girls are pretty vocal in telling us that we are their favorite group.  We try to keep their interests in mind and take a different meal and craft/game each time.  There is never a dull moment, and we always leave smiling ear to ear.  I believe they look up to us in many ways and I have to say the feeling is mutual. Watching their personalities grow and mature has been so rewarding.  Seeing a hurt, teenage girl enter the program very timid and afraid, and watching her blossom over the course of her stay into a beautiful, well-mannered and confident young lady ready to take on the world.  That is what it’s all about. Because every girl is worth it!

The North Carolina Workers’ Compensation Act requires that all businesses which have three or more employees obtain Workers’ Compensation insurance.  It does not matter if these employees are full time, part time, seasonal, or family members.  Failing to do so may result in stiff financial penalties and/or being charged with a misdemeanor or felony.

One question we often get, is whether or not the owner of the firm counts towards the number of employees.  This answer depends on the legal entity.  In a corporation, officers are automatically counted as employees.  Although they may elect to exclude themselves from coverage, they are still counted in determining whether a business has three or more employees.  Whereas for sole proprietorships, partnerships, or limited liability companies, the respective owner, partners, or members are not counted as an employees.  Even though they do not count as an employee, they may still choose to include themselves in coverage.

Work Comp base rates vary by state and are based on the classification of business.  For example, a contractor will have much higher rates than clerical workers because the risk of injury is higher.  The base rate designated for that type of employment is then multiplied by gross payroll (per $100) to determine the premium.  When considering payroll, a minimum or maximum, per individual, may apply in certain situations.  For example, corporate officers have a minimum and maximum payroll: $41,600 / $83,200 (as of 4/01/2014).  If a sole proprietor or partner chooses to be included in coverage, a flat amount of $41,800 is used (as of 4/01/2014).  Regular employees do not have a minimum or maximum and are rated on their actual payroll amounts.

You should expect your Workers’ Compensation policy to be audited at the end of each policy term.  The carrier will ask for payroll information and based on the findings, will credit or debit your premium accordingly.  It is important to notify your agent if you have a major increase or decrease in payroll so that adjustments can be made mid-term.

If you have further questions regarding Workers’ Compensation or would like a quote, please contact Kelly or Adam at Lawyers Insurance.

What exactly is UM/UIM and what does it cover?  Uninsured Motorists (UM) and Underinsured Motorists (UIM) is designed to cover the cost of medical bills, lost wages, or property damage when you are involved in an accident and the party at fault is either underinsured or not insured at all.

Some facts that may surprise you:

  • 213,406 traffic accidents were reported in North Carolina in 2012 ( Source: NC Department of Transportation)
  • 110,406 persons injured due to 2012 accidents in North Carolina (Source: NC Department of Transportation)
  • 1,663 hit-and-run accidents reported in 2012 ( Source:  AAA of the Carolinas)
  • One in eight drivers were uninsured in 2012 ( Source: 2014 study by the Insurance Research Council)
  • North Carolina minimum liability limits are $30,000 for bodily injury per person, $60,000 bodily injury per accident, and $25,000 property damages

Life is unpredictable.  Consider if you or your passengers were injured in an auto accident where the other driver is legally responsible and either uninsured or underinsured.  What if this caused you to be out of work for several months and resulted in lost wages?  Don’t leave it to others to protect your financial interests.  Take a few moments to review your current limits and call your agent with any questions.
